This Agreement is for all Web Hosting, Web Design, Site Development and Managed Care customers.  This agreement stands as a Contract between WebExpressportal and all whom purchase a product under a managed care service.  Therefore, any mention of the word "product" (non-case sensitive) within this contract will be understood as a purchased managed care service governed by this agreement. It must be understood that during the purchase phase prices and information are and will be available to you.  This agreement can be easily found through-out WebExpressPortal’s website.  Therefore, any disagreement of this agreement after product purchasing will not release you from this agreement.  Should you not except product after purchasing you will not receive a refund for any setup fees.  You will not receive a full refund if site development has begun.  If a refund does occur, the amount will be refunded at a rate of: "(product price) - (set-up fees) - ( un-used whole month hosting pre-paid fees) - ($40.00 an hour site development fees) = refund". In order to create a design layout for your website, you will need to offer as much detail as possible so the layout can be rendered.  If you do not provide the details required to design the website and you are dissatisfied with the outcome, you will be allowed a second layout designed.  However, if you are not satisfied with the second layout you will be required to pay $40 an hour for site development until you are satisfied with the site layout.  During the site build and regardless if the layout is in its first or, second layout phase you will only be allowed (2) content edits without incurring extra charges.  Content edits include text, photos and or, viewable object.  You must understand that the content is rendered for web use only and it is your responsibility for any spelling and/or grammer errors. All services are to be used for website display, database interaction, script interaction and/or the product intended use ONLY! Under no circumstances are you allowed to do the following: Gather information not owned by you. Pursue, cross compile, get, acquire, manipulate, or change any portion of a file, image, internet source and computer source that you do not have a legal right too. Anything that would deem illegal activity. IRC, gaming, persistent connections Spam, Hack, Stock individual(s), Display Pornographic materials, Sell illegal drugs or Advertise illegal drugs. Be deceitful. Any code or script or file that produces or results in illegal behavior. Give access to, or share any username and/or password. Use of the design works outside of website display without permission. Use of the works outside of the primary domain set-up for this service. It must be understood that you do not have copyright ownership of any product and/or works produced by WebExpressPortal until you have made a full market value payment.  WebExpressPortal.com has full copyright on all works.  Only WebExpressPortal will decide on the full market value.  Should you wish to cancel the service(s) all works outside of customer materials will not be released until the full market value is paid.  The product was offered to you at a below market rate.  Should you wish to move these works to another location you will be required to make full payment in order to release all works.  Any initial start-up costs involved will be subtracted, not including the set-up fees.  The copyright, developed by statements and or, any marketable link to WebExpressPortal pages within the product will not be removed until the above full payment is made.  Should works developed be discovered outside of the intended target without a release of copyright form a suit will incur.  If your site is managed by WebExpressPortal.com for a full (2) year period the ownership of your site will be released to you in full with the exception of the editor and any file and image that does not hold a WebExpressPortal.com copyright.  If you qualify for copyright ownership per this agreement you may request that we remove the marketable links to the WebExpressPortal.com website.  However, if a violation of this agreement is found the copyright ownership is void and webexpressportal.com will hold full copyright permanently. It must be understood that though the editor is custom plugged into your website for use as a site editing solution, you do not own the editor.  You have/are paying for a license to use the editor only.  The editor will not be packaged with your website should you wish to move your hosting to another source. It must be understood WebExpressPortal may turn to photo sources in order to design a site.  Should your site hold a photo not owned by you, it is your responsibility to seek ownership and/or photo marketing rights or, display rights. With this product you will receive a free domain Registration free of charge for the (1) domain that is used during set-up.  The free registration will occur each year that the product is active.  The domain must be registered through the WebExpressPortal.com registry service via a new registration or, transfer.  Under no circumstances is there any free service for a domain that is not registered with WebExpressPortal registry services. Should the service be canceled due to non-payment and/or service violation and if the domain is registered through WebExpressPortal.com services, it will be placed as a parked domain.  Should the domain be in parked status, it will be your responsibility to make the yearly payments and that your domain does not expire by logging in at; http://www.webexpressportal.com/domain-tools/administer/.  When a domain is in parked status all free services, including the yearly registration fees that are offered to you within the package offerings will no longer be honored.  Domain owners will need to service their own parked domains by going to http://www.webexpressportal.com/domain-tools/administer/.  The parked domain page will state that your domain is in parked status.  The parked page will also hold marketing content for WebExpressPortal.com. When a password is needed, WebExpressPortal will create one for you.  WebExpressPortal does not allow customer(s) to choose their own password(s). You are not allowed to mass email and/or use the resources to spam others. As a non-dedicated server customer you may not use the resources to share your sites contents. You are "ONLY Allowed" to use the resources to send and check mail and for others to interact directly with your website pages.  You may not mirror any page and/or content.  Should the discovery of high bandwidth use be an issue with your site, a charge of $10.00 per Gigabyte will incur. Under no circumstances are any page(s) to hold profanity, nudity (partial or, full), illegal activity or, behaviors that may otherwise harm another living being. All payments are made monthly and processed automatically through the credit card used during the initial purchase of this product.  If a payment is declined for any reason there will be a $30.00 fee for each occurrence.  It is your responsibility to notify WebExpressPortal.com by phone or, email if your credit card is nearing expiration or has expired.  If you require WebExpressPortal.com to process a credit card other than the one used for the purchase of the product it is your responsibility to contact WebExpressPortal.com via phone or, email with this information.  If payment is not received within 5 days prior to the next months hosting cycle, all services related to this product will be canceled and you will not receive a refund.  If there is a cancellation you will need to start the purchase process over in order to use the web hosting services.  If there is a cancellation you will be held responsible should you loose any information that was hosted or, maintained by WebExpressPortal.  Refunds will be for full month fees only.  There will not be a refund for set-up fees.  Any fees due to WebExpressPortal will be pursued through the Court System should you refuse to make payment.  WebExpressPortal will decide which city and state to have the Court Proceedings regardless of the nature of the proceedings.  Should a claim be filed against you, you will be fully responsible for any legal fees for both sides. It is your responsibility to check back and read this agreement month to month.  This agreement may be appended when product enhancements and/or changes occur.  You are required to be fully aware with the new agreement and your acceptance of the new agreement contract in order to maintain the product(s) active status.  Should a change occur within the agreement that you disagree with the product will be canceled and there will be no refund. It must be understood that every attempt is made to provide you an outstanding service.  You must understand that the Internet is not owned by any one entity.  Therefore, should any part of your service become harmed or unavailable you relinquish your right to file suit or file a claim against WebExpressPortal and owner(s) of WebExpressPortal and any entity that maintains the WebExpressPortal.com website upon accepting this contract.  Regardless of the nature of the occurrence(s) to your service and Product you will hold WebExpressPortal and owner(s) of WebExpressPortal and any entity that maintains the WebExpressPortal.com website completely blameless upon accepting this agreement.  Upon accepting this contract you and any individual(s) whom are associated with this Product and service will relinquish their right to pass blame and/or file suit/blame of any sort against WebExpressPortal and owner(s) of WebExpressPortal and any entity that maintains the WebExpressPortal.com website.  It is understood that you and any individual(s) who is involved in the purchasing of this Product has completely read this contract and completely acknowledged this contract and fully accepted this contract in its entirety. You and any one affiliated with this product purchase must be 18 years old or older.  Upon accepting this contract you are stating that you are the authorized user of the credit card to be used to purchase this Product.  Upon accepting this contract you are stating that you have read this contract in its entirety and acknowledged this contract in its entirety and accepted this contract in its entirety and fully agreed to this contract in its entirety.  Upon accepting this contract and purchasing this Product you will be bound to the terms of this contract in its entirety.
